Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FrameBox mobile application (“App”) and related services provided by Indie Apps (“we,” “our,” or “us”). By downloading, installing, or using FrameBox, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using FrameBox, you confirm that you are at least 13 years of age (or the applicable age of digital consent in your jurisdiction), that you have the legal capacity to enter into a binding agreement, and that you agree to comply with these Terms.

If you are using FrameBox on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

These Terms incorporate our Privacy Policy, which is hereby incorporated by reference.

2. Description of the App

FrameBox is a mobile photo-framing application for iOS that allows users to add borders and frames to photos in order to fit specified aspect ratios without cropping the original image content. Core functionality includes:

  • Selecting photos from the device camera roll
  • Applying white, black, blurred, or color-matched borders
  • Choosing from predefined aspect ratio presets (e.g., 1:1, 4:5, 9:16, 16:9)
  • Customizing border width and color (Pro feature)
  • Exporting framed photos at full resolution
  • Sharing framed photos to third-party apps and services
  • Batch-processing multiple photos (Pro feature)

We reserve the right to modify, update, suspend, or discontinue any part of the App at any time, with or without notice.

3. License Grant

Subject to your compliance with these Terms, Indie Apps grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on any iOS device that you own or control, solely for your personal, non-commercial purposes.

You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except to the extent permitted by applicable law
  • Remove, alter, or obscure any proprietary notices (including copyright, trademark, or patent notices) in the App
  • Use the App for any commercial purpose or for any public display without our prior written consent
  • Transfer, sell, sublicense, or otherwise make the App available to any third party
  • Use the App in any manner that could damage, disable, or impair the App or our servers

4. Free and Pro Tiers

4.1 Free Tier

The Free tier of FrameBox is available at no charge and includes:

  • Up to 3 framed photo saves per calendar day
  • 8 standard aspect ratio presets
  • White and black border options
  • One-tap sharing
  • Save to camera roll

Free tier usage limits reset at midnight UTC each day. We reserve the right to adjust Free tier limits at our discretion with reasonable notice.

4.2 Pro Tier

The FrameBox Pro subscription unlocks additional features, including:

  • Unlimited framed photo saves
  • Batch processing of up to 10 photos per operation
  • Custom border colors (full color picker)
  • Adjustable border width
  • Priority customer support
  • Early access to new features

Pro features are available upon active subscription. If your subscription lapses or is cancelled, your access to Pro features will terminate at the end of your current billing period and your account will revert to Free tier limits.

5. Subscriptions and Billing

5.1 Subscription Plans

FrameBox Pro is available as a weekly subscription (€0.99/week), an annual subscription (€6.99/year), or a one-time lifetime purchase (€14.99). Prices are in EUR and may vary by region based on local currency and applicable taxes. The prices displayed at checkout on the App Store are the final prices you will be charged.

5.2 Free Trial

We may offer a free trial period for FrameBox Pro (typically 7 days). At the end of the free trial, your subscription will automatically renew at the applicable subscription rate unless cancelled before the trial period ends. You will not be charged during the trial period.

5.3 Billing and Renewal

All purchases are processed through the Apple App Store. Your Apple ID account will be charged when you confirm a purchase. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.

Apple may adjust subscription prices from time to time. If a price change occurs, you will be notified in advance and given the option to accept the new price or cancel.

5.4 Cancellation

You may cancel your FrameBox Pro subscription at any time through your Apple ID account settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused portions of a subscription period.

5.5 Refunds

All purchases are final and non-refundable, except where required by applicable law. Refund requests must be submitted directly to Apple through their standard refund process at reportaproblem.apple.com. Indie Apps does not have the ability to process refunds directly.

6. User Content

You retain full ownership of all photos and content you process through FrameBox (“User Content”). By using the App, you grant Indie Apps no license to your User Content — we do not access, store, or use your photos in any way. All photo processing occurs on-device.

You represent and warrant that:

  • You own the User Content you process through the App or have the necessary rights, licenses, consents, and permissions to use it
  • Your User Content does not violate the intellectual property rights, privacy rights, or any other rights of any third party
  • Your User Content does not violate any applicable law or these Terms

You are solely responsible for your User Content and any consequences of processing, saving, or sharing it.

7. Prohibited Uses

You agree not to use FrameBox to:

  • Process, frame, or share content that is illegal, obscene, defamatory, threatening, infringing, or otherwise objectionable
  • Violate any applicable local, national, or international law or regulation
  • Infringe the intellectual property rights of any third party
  • Attempt to gain unauthorized access to any systems, networks, or servers used by Indie Apps
  • Interfere with or disrupt the integrity or performance of the App
  • Use automated tools, bots, or scripts to access or interact with the App in a manner inconsistent with its intended use
  • Circumvent, disable, or otherwise interfere with any security-related features of the App
  • Share child sexual abuse material (CSAM) or any content that exploits or harms minors
  • Use the App in connection with any harassment campaign, doxxing, or harm to any individual

Violations of these prohibited uses may result in immediate termination of your access to the App and, where appropriate, referral to law enforcement.

8. Intellectual Property

The App, including its design, features, software code, graphics, logos, trademarks, and trade dress, is owned by Indie Apps or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

The “FrameBox” name and logo are trademarks of Indie Apps. You may not use our trademarks without our prior written permission.

Nothing in these Terms grants you any right, title, or interest in the App or its intellectual property beyond the limited license described in Section 3.

We welcome feedback, ideas, and suggestions (“Feedback”). By submitting Feedback, you grant Indie Apps a perpetual, irrevocable, royalty-free license to use, incorporate, and commercialize your Feedback without any obligation or compensation to you.

9. Third-Party Services

FrameBox integrates with or links to third-party services and platforms. These include, but are not limited to:

  • Apple App Store — for distribution and payment processing
  • RevenueCat — for subscription management
  • PostHog — for anonymous product analytics

Your use of third-party services is governed by their respective terms of service and privacy policies. Indie Apps is not responsible for the practices of any third-party service.

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • Any errors or defects in the App will be corrected
  • The App will meet your requirements or expectations
  • Any results obtained from the App will be accurate or reliable

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such cases, our warranties are limited to the minimum extent permitted by applicable law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INDIE APPS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF INDIE APPS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO INDIE APPS IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. Accordingly, the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Indie Apps and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your User Content and your use or processing of any photos through the App
  • Your violation of any third party's intellectual property rights, privacy rights, or other rights
  • Your violation of any applicable law or regulation

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Indie Apps operates, without regard to conflict of law principles.

Before filing any formal legal claim, you agree to first contact us at framebox143@gmail.com and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally.

If the dispute cannot be resolved informally, any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of competent jurisdiction, and you consent to personal jurisdiction in those courts.

TO THE EXTENT PERMITTED BY LAW, YOU AND INDIE APPS EACH WAIVE THE RIGHT TO A JURY TRIAL AND AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS RATHER THAN IN A CLASS OR REPRESENTATIVE ACTION.

14. Termination

These Terms remain in effect until terminated. You may terminate them at any time by deleting the App from your device.

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice, if we determine that you have violated these Terms or that your use of the App poses a risk to Indie Apps or other users.

Upon termination, the license granted to you under Section 3 will immediately cease. Sections 6, 8, 10, 11, 12, 13, and 15 shall survive termination of these Terms.

15. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will:

  • Update the “Last Updated” date at the top of this page
  • Provide a notice within the App
  • Notify you via email if you have contacted us and provided an address

Your continued use of FrameBox after any updated Terms become effective constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the App.

16. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Indie Apps regarding the App and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision in these Terms will not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure: We will not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including natural disasters, acts of government, telecommunications failures, or internet outages.
